DATA PROTECTION POLICY PART 2:
FUTURE CONNECTED FIBRE LTD shall comply with applicable Data Protection Laws in respect of its processing of Personal Data;
· To the extent that FUTURE CONNECTED FIBRE LTD processes Personal Data in the course of providing any services in respect of which Customer is the controller and which is provided to FUTURE CONNECTED FIBRE LTD by or on behalf of Customer in connection with the provision of services, FUTURE CONNECTED FIBRE LTD shall act as Processor on behalf of Customer.
· The nature and purpose of the processing, the type of Customer Personal Data and categories of Data Subject as required by applicable Data Protection Law.
· Only process Customer Personal Data in accordance with the documented instructions of Customer (including to the extent necessary to provide the Services and to comply with its obligations under relevant legislation);
· Inform Customer if, in FUTURE CONNECTED FIBRE LTD's opinion, any of Customer's instructions would breach Data Protection Laws; and
· Assist Customer with undertaking an assessment of the impact of processing Customer Personal Data, and with any consultations with a Supervisory Authority, if and to the extent an assessment or consultation is required to be carried out under Data Protection Laws.
· Implement appropriate technical and organisational measures for the fulfilment of Customer's obligation to respond to requests by Data Subjects to exercise their rights of access, rectification or erasure, to restrict or object to processing of Customer Personal Data, or to data portability; and
· If a Data Subject who is a customer of Customer makes a written request to FUTURE CONNECTED FIBRE LTD to exercise any of the rights, forward the request to Customer promptly and shall, upon Customer's reasonable written request, provide Customer with all co-operation and assistance requested by Customer, acting reasonably, in relation to that request to enable Customer to respond to that request in compliance with applicable deadlines and information requirements.
Taking into account the state of the art, the costs of implementation and the nature, scope, context and purpose of processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, implement and maintain appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including the risk of unauthorised or unlawful processing of Customer Personal Data, and of accidental or unlawful loss, alteration, unauthorised disclosure or destruction of, or damage to, Customer Personal Data (including all measures required by Article 32 GDPR); and notify Customer without undue delay after becoming aware of a Personal Data Breach in respect of Customer Personal Data, and upon Customer's reasonable written request, provide Customer with all co-operation and assistance requested by Customer, acting reasonably, to enable Customer to notify that Personal Data Breach to the relevant Supervisory Authority and relevant Data Subject(s) (as applicable).
FUTURE CONNECTED FIBRE LTD shall not engage another processor to process Customer Personal Data without prior specific or general written authorisation of Customer and in the case of general written authorisation, inform Customer of any intended changes concerning the addition or replacement of other processors, thereby giving Customer the opportunity to object to such changes.
However, Customer authorises FUTURE CONNECTED FIBRE LTD to engage any processor involved in providing the following services to, or on behalf of, FUTURE CONNECTED FIBRE LTD: installation, network operations and network repair, in each case in connection with provision of installation, repair and cease activities; and before disclosing Customer Personal Data to any subprocessor, enter into a contract with that subprocessor under which the processor agrees to comply with obligations.
FUTURE CONNECTED FIBRE LTD shall, before disclosing Customer Personal Data to any of its employees and representatives, and the employees and representatives of each of its processors, in each case who have access to the Customer Personal Data, take reasonable steps to ensure that those persons:
· have undergone appropriate training in data protection and the care and handling of Personal Data; and
· are bound to hold the information in confidence to at least the same standard
FUTURE CONNECTED FIBRE LTD shall not transfer Customer Personal Data to, or process Customer Personal Data in, any third country or territory without the prior written consent of Customer (such consent being conditional upon FUTURE CONNECTED FIBRE LTD unless and for so long as:
· there has been a European Community finding of adequacy pursuant to Article 45 of the GDPR in respect of that country or territory; or
· Customer and the relevant importing entity are party to a contract in relation to the export of Customer Personal Data incorporating standard contractual clauses in the form adopted by the European Commission under Decision 2010/87/EU or an equivalent data transfer agreement meeting the requirements of Data Protection Laws; or
· FUTURE CONNECTED FIBRE LTD takes such other steps as are necessary to ensure the transfer of Customer Personal Data meets the requirements of Data Protection Laws.
